The Service is operated and maintained by the individual independent developers and creators of botbotic.net (collectively referred to as “we”, “us”, “our”, or the “Developers”). These Terms and Conditions (“Terms”) govern your access to and use of botbotic.net, including any content, functionality, software tools, algorithms, and services offered on or through the Website.

Please read these Terms carefully before using the Service. By accessing or using the Service, creating an account, or purchasing a subscription, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service.

  1. ACCEPTANCE OF TERMS
    By accessing, creating an account, or using botbotic.net, you affirm that you are at least 18 years of age (or the age of majority in your jurisdiction) and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms.
  2. DESCRIPTION OF SERVICE
    botbotic.net provides automated cryptocurrency spot trading software tools, execution algorithms, and integration services via external third-party cryptocurrency exchange APIs (the “Service”). We reserve the right to modify, suspend, update, or discontinue any aspect, feature, or tool of the Service at any time without prior notice or liability.
  3. USER ACCOUNTS AND SECURITY
    To access certain features of the Service, you may be required to register and maintain an active user account.
  • Responsibility: You are solely responsible for maintaining the strict confidentiality of your account credentials (usernames, passwords) and your external exchange API keys.
  • Authorization: You agree to accept full responsibility for any and all activities, orders, or actions that occur under your account, whether authorized by you or not.
  • Breach Notification: You must notify us immediately at info@botbotic.net upon becoming aware of any breach of security, unauthorized use of your account, or compromise of your API keys.
  1. PROHIBITED USES
    You agree not to use the Service:
  • For any unlawful purpose or in violation of any local, state, national, or international law or regulation.
  • To exploit, harm, or attempt to exploit or harm minors in any way.
  • To transmit, or procure the sending of, any advertising or promotional material, including “junk mail,” “spam,” or any other similar solicitation.
  • To impersonate or attempt to impersonate botbotic.net, its Developers, another user, or any other person or entity.
  • To engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the Service, or which, as determined by us, may harm botbotic.net or users of the Service.
  • To reverse engineer, decompile, or attempt to extract the source code or underlying algorithms of the software tools provided.
  1. INTELLECTUAL PROPERTY
    The Service and its original content, features, and functionality (including but not limited to software code, execution logic, trading algorithms, user interface, web design, and text) are and will remain the exclusive property of the Developers of botbotic.net. Our intellectual property, trademarks, logos, and trade dress may not be used in connection with any product or service without our express prior written consent.
  2. PAYMENT, SUBSCRIPTIONS, AND REFUNDS
  • Billing: Certain parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis (such as monthly or annually), depending on the subscription plan you select.
  • Merchant of Record: Payments may be processed through an external authorized Merchant of Record or third-party payment provider. You agree to comply with their respective terms of service when making payments.
  • Refunds: Except when strictly required by applicable consumer law, all paid subscription fees are completely non-refundable.
  1. NO FINANCIAL ADVICE AND TRADING RISKS
  • Educational and Automation Purposes Only: The content, software tools, features, and algorithms provided by botbotic.net are designed strictly for informational, analytical, and trade-automation purposes. They do not constitute, and shall not be construed as, financial, investment, legal, tax, or trading advice. We are not financial advisors, brokers, or fiduciaries.
  • Non-Custodial Nature: Botbotic.net is a strictly non-custodial software provider. We do not hold, store, manage, possess, or have direct access to your funds, fiat currencies, or cryptocurrencies. You connect your external exchange accounts via your own API keys at your sole risk. You are entirely responsible for setting appropriate permissions and restrictions (such as disabling withdrawal permissions) on your API keys.
  • Assumption of Risk: Cryptocurrency trading involves an extremely high level of risk and volatility, which can lead to a substantial and immediate loss of capital. You acknowledge and agree that any trading decisions, automated or manual, made through or because of the use of the Service are made at your own discretion and risk. We do not guarantee any profits, specific outcomes, or performance metrics. Past performance of any algorithm or historical backtesting is not an indicator of future results.
  1. LIMITATION OF LIABILITY
    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE INDIVIDUAL CREATORS, DEVELOPERS, OR OPERATORS OF BOTBOTIC.NET BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, TRADING LOSSES, REVENUE, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THIS SERVICE.

UNDER NO CIRCUMSTANCES WILL THE DEVELOPERS BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, SYSTEM CRASHES, API DISCONNECTIONS, THIRD-PARTY EXCHANGE DOWNTIME, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE, YOUR ACCOUNT, OR THE API KEYS CONNECTED THERETO.

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF THE DEVELOPERS FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE EXCEED THE TOTAL AMOUNT PAID BY YOU TO BOTBOTIC.NET FOR THE SERVICE DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED US DOLLARS ($100.00), WHICHEVER IS GREATER.

  1. “AS IS” AND “AS AVAILABLE” DISCLAIMER
    YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

WE DO NOT WARRANT THAT THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURELY, FREE OF ERRORS, BUGS, OR MALFUNCTION, OR THAT ANY DEFECTS WILL BE IMMEDIATELY CORRECTED.

  1. GOVERNING LAW
    These Terms and any dispute, claim, or controversy arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
  2. BINDING ARBITRATION AND CLASS ACTION WAIVER
    PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
  • Individual Binding Arbitration: You and the Developers agree that any dispute, claim, or controversy arising out of or relating to these Terms, or the breach, termination, enforcement, interpretation, or validity thereof, shall be settled and resolved exclusively by binding individual arbitration.
  • Virtual/Online Proceedings: The arbitration shall be conducted entirely in a virtual, online format through an established, internationally recognized alternative dispute resolution (ADR) provider, to be mutually agreed upon by the parties. The arbitration proceedings, documentation, and hearings shall be conducted entirely in the English language. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.
  • Class Action Waiver: YOU AND THE DEVELOPERS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims or preside over any form of a class proceeding.
  1. ELIGIBILITY AND SANCTIONS COMPLIANCE
    By accessing and using the Service, you represent and warrant that:
  • You are not located in a country or territory that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government or international authorities as a “terrorist supporting” region.
  • You are not listed on any U.S. Government, European Union, or international list of prohibited, sanctioned, or restricted parties (including, but not limited to, the Office of Foreign Assets Control (OFAC) Specially Designated Nationals list).
    If your status under this section changes, you must immediately cease all use of the Service and delete your account.
  1. CHANGES TO TERMS
    We reserve the right, at our sole discretion, to modify, update, or replace these Terms at any time. We will provide notice of any material changes by posting the revised Terms on this webpage and updating the “Last Updated” date at the top. Your continued use of or access to the Service following the posting of any changes constitutes binding acceptance of those modified Terms.
  2. SEVERABILITY AND ENTIRE AGREEMENT
    If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted or modified to the minimum extent necessary without affecting the remaining provisions herein. These Terms constitute the entire agreement between you and the Developers regarding the Service.
